NEW DELHI: With many rape survivors rushing to court for permission for medical termination of their unwanted pregnancies after the 20-week threshold, the Supreme Court on Friday asked the Union government about the feasibility of setting up district medical boards to help and advice women about timely abortion.
This query came from a bench of Chief Justice S A Bobde and Justice A S Bopanna while hearing the plea of a minor rape survivor who sought a direction from the court for termination of her 26-week pregnancy. After going through the medical board report which opined against termination given the age of the girl and the advanced stage of pregnancy, her advocate V K Biju requested the SC to do something to help such survivors who do not reveal the pregnancy out of shame till it is too late for termination.
He said during his two-decade practice in the SC, he had come across numerous cases where pregnant rape survivors pleaded with the court to direct the government to set up a mechanism or medical board in every district, which would help, advice and take care of similarly placed women. This suggestion was taken favourably by the CJI-led bench. The Medical Termination of Pregnancy Act permits abortion till 12 weeks on the advice of one doctor and up to 20 weeks on the concurrent opinions of two doctors.
